Disclaimer and Informed Consent Agreement for Energy Healing and Wellness Services

Location: Services are provided at 376 State Route 28 Bridgewater, NJ 08807, or any other location where these services may be performed, including but not limited to yoga studios, hospitality venues, academic settings such as universities or schools, client private residences, and corporate offices (each a “Location”). Practitioner/Company: Reiki & Soul Healing LLC

Preamble

The services offered by Reiki & Soul Healing LLC, including Reiki, Meditation, Sound Healing, Sacred Ceremonies, Aura Photography, and any other healing event or wellness service (collectively, the “Services”), are complementary, energy-based techniques that aim to promote deep relaxation, stress reduction, and well-being. These practices operate on the principle that the human body possesses an intrinsic ability to balance and heal itself, a process which can be aided by achieving a state of deep relaxation. Please note that achieving balance in cases of long-standing imbalances may require multiple sessions to achieve the optimal level of relaxation for self-healing.

By booking an appointment for these Services, you acknowledge and understand the following, and confirm that you are legally authorized to agree to these terms on behalf of any minor or adult participant for whom you are booking a session:

1. Holistic Approach and Non-Medical Practice

• • Holistic Approach: The Services are provided as a holistic approach to well-being. These Services should be seen as a complement to, rather than a substitute for, traditional medical or psychological diagnosis, treatment, or care.
  • Non-Medical Practitioners: Our practitioners are not licensed medical or psychological professionals. Therefore:
    • They do not diagnose medical or psychological conditions.
    • They do not prescribe or administer any form of medical treatment or substances.
    • They do not provide any medical or psychological advice.
    • They will not interfere with any treatment prescribed by a licensed medical professional.
  • Medical Consultation: If you are experiencing a physical or psychological ailment, it is highly recommended that you seek the attention and advice of a licensed physician or qualified healthcare professional. Always consult your physician or other qualified health provider for advice regarding your medical condition.

2. Potential Benefits and Risks

• Individual Experiences: While the Services may provide potential benefits such as relaxation, stress reduction, and a sense of well-being, you recognize that individual experiences and outcomes may vary.
• Assumption of Emotional and Mental Risk (Professional Liability): You acknowledge that the nature of these Services, particularly energy work, ceremonial, and deep relaxation techniques, may result in emotional release, mental shifts, or the manifestation of discomfort or dissatisfaction. You assume all risks, known or unknown, associated with your participation, including the potential for emotional or mental setback or claims that the Service was ineffective, and you agree to communicate any concerns or adverse reactions to the practitioner immediately.

3. Confidentiality and Voluntary Participation

• Confidentiality: Any personal information or discussions shared during the Services will be treated with utmost confidentiality. Your privacy will be respected, and no information will be disclosed to third parties without your explicit consent, except as required by law.
• Voluntary Participation: You affirm that your participation in all Services is entirely voluntary and that you have chosen to engage in this practice of your own free will. You retain the right to discontinue the session at any time if you feel uncomfortable or overwhelmed.
• Informed Decision: You confirm that you have been given the opportunity to ask questions and seek clarification regarding the nature, purpose, potential benefits, and risks associated with these Services, and you have made an informed decision to participate.

4. Release of Liability and Assumption of Physical Risk

• In consideration of the right to participate in services provided by Reiki & Soul Healing LLC (the “Activity”), I hereby, for myself and for all participants I book this session(s) for, including my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability.

• I agree to waive any and all rights, claims, or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge Reiki & Soul Healing LLC, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, from any injury, damage, or loss that I may suffer as a direct result of my participation in the aforementioned Activity, including:
• Physical Environment and Equipment Risk (General Liability): I am aware of the risks associated with traveling to and from, as well as participating in this activity, which may include, but are not limited to, physical injury, pain, suffering, and property loss. I understand that the practice location, whether an in-home studio or an off-site vendor location (e.g., hotel ballroom, corporate office), may contain common hazards, including but not limited to, rugs, mats, props, and sensitive musical instruments (e.g., singing bowls, gongs, tuning forks). I assume all risks of injury, including those resulting from falls, slips, trips, or contact with equipment (such as tripping over a sound bowl), and I will exercise reasonable caution at all times while on the premises.
• Claims for Services: Any physical or psychological injury, illness, disfigurement, disability, economic or emotional loss, or death that may arise from my own or others’ negligence, conditions related to travel, or the condition of the activity location(s).

5. Client Liability for Property Damage

• Damage to Equipment and Third-Party Property (Business Personal Property/General Liability): If any damage occurs to the equipment utilized by Reiki & Soul Healing LLC (including, but not limited to, sensitive sound healing instruments, yoga props, and associated goods) or to the facilities of Reiki & Soul Healing LLC or a third-party vendor location (e.g., a hotel, client’s home, corporate office) as a result of my or my family’s willful actions, neglect, or recklessness, I acknowledge and agree to be held fully liable for any and all costs associated with the repair or replacement of said equipment or property.
• Financial Responsibility: If I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

6. Indemnification and Final Agreement

• I agree to indemnify and hold harmless Reiki & Soul Healing LLC against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf.
• To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of Reiki & Soul Healing LLC, its agents, and employees.

By booking an appointment, you confirm that you have carefully read this “Disclaimer and Informed Consent Agreement” and Release of Liability, and fully understand that it is a release of liability. You expressly agree to release and discharge Reiki & Soul Healing LLC and all its representatives from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I otherwise have to bring a legal action against the company for personal injury or property damage.
